This Privacy Policy applies to Cineplex Digital Media Inc. and its wholly owned subsidiaries, affiliates, and related entities (collectively, “CDM” or “our”, “we”, or “us”). The contents of this Privacy Policy are intended to be read and understood in accordance and compliance with all applicable privacy laws, statutes and regulations in the jurisdictions where CDM operates.

The purpose of this Privacy Policy is to inform our job applicants, customers and other individuals with whom we deal ("you" and "your") about how we collect, use, share and protect Personal Information while engaging with us, through any of our applications (the “Applications”) and through our website, cdmexperiences.com (the “Website”). This Privacy Policy applies to the collection, use, sharing, processing and protection of your Personal Information by CDM.

Your use of our Applications and Website is further governed under the Terms of Use as indicated on such Applications and Website.

Definition of Personal Information

Personal Information is information about an identifiable individual including, without limitation, information such as your name, address, birth date, personal contact information and other information described below. It may also include other types of more technical information such as IP addresses, geolocation, device ID, or browsing history in connection with our Applications or Website, but only when this information can identify you as an individual. Information that is aggregated and cannot be associated with an identifiable individual is not considered to be Personal Information.

Personal Information We Collect Directly from You

CDM and its employees, agents, contractors, service providers, partners and representatives may collect the following Personal Information that you provide to us:

• Contact Information that you may provide to us, for instance, when you make an inquiry through one of our Applications or Website, by mail, telephone, email, SMS, social media, or any other means of electronic communication (e.g. name, home address, home or mobile telephone number or e-mail address); and
• Survey Responses that you provide (e.g. when you provide your name or other contact information in order to take part in a survey). 

Personal Information We Collect Automatically

In some cases, we may collect information automatically which may not necessarily identify you as an individual. For instance, we may collect the following type of information:

• On Premises Devices and Imaging Technology. We may use on premises imaging technologies (e.g. anonymous video analytics and anonymous traffic analysis) at our physical advertising installations for the following purposes:
  • measuring viewer engagement and interest with visual media in order to improve digital displays and signage; and
  • forecasting trends and traffic patterns to improve resource allocation and management.

The above-described devices and imaging technologies are strictly used for the purposes of anonymous and aggregated analysis (i.e. non-identifying purposes) and do not store images of individuals.

• Technical Information. The nature of internet browsing is such that this activity passively and automatically collects and discloses certain information about an individual’s use of the internet. This information may be associated with an individual’s Internet Protocol ("IP") address. This is a unique internet "address" which is assigned to all internet users by their Internet Service Provider ("ISP"). Our server logs record statistical information, such as visitors' IP addresses, type of operating system, time and duration of visit, webpages requested, as well as identifying categories of visitors by items such as domains and browser types. We may also track devices which have communicated with our Wi-Fi systems at our physical locations, but such tracking is conducted without the storage of information that is personally identifying.
• Cookies. Our Applications and Website makes use of both "sessional" and "persistent" cookies or similar technologies. Cookies are small text files offered to your computer by Web servers to keep track of your browser settings as you navigate the site. Persistent cookies are stored on your hard drive. Sessional cookies are stored in temporary (cache) memory and are deleted when you shut down your browser or turn off your computer. We use these cookies or similar technologies to store your preferences, record session information such as language preferences, record user-specific information on what pages you access or visit, develop information about your preferences and interests, alert you to areas that we think might be of interest to you when you return to our site, record past activity in order to provide better service when you return to our site, help rotate banner advertising so as to ensure that visitors are not repeatedly sent the same banner ads, and customize content based on your browser type or other information you provide. • We may use Hotjar and other automated information collection tools to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices (in particular device’s IP address (captured and stored only in anonymized form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), preferred language used to display our website). Hotjar stores this information in a pseudonymized user profile. Neither Hotjar nor CDM will ever use this information to identify individual users or to match it with further data on an individual user. Use of Your Personal Information

We collect and use Personal Information with your consent or as otherwise permitted or required by law, for general business purposes such as providing or delivering products or services, administering our business, Applications and Website. More specifically, we may use your Personal Information for the following general purposes:

• To present the Website and its contents to you;
• To provide you with information, products, or services that you request from us;
• To fulfill the purposes for which you provided the information or that were described when it was collected, or any other purpose for which you provide it;
• To carry out our obligations and enforce our rights arising from any contracts with you, including for billing and collection or to comply with legal requirements;

• Your Personal Information may be transferred to service providers, who may or may not be affiliates of CDM, where such entities provide services on our behalf (e.g. administrative, management, operational, support, marketing or other services). They are prohibited from using the information for purposes other than to facilitate and carry out the services they have been engaged to provide. These service providers are not permitted to disclose this information to others. CDM will strive to protect Personal Information shared with third parties with contractual agreements.

All CDM employees, agents, contractors, service providers, partners and representatives who have access to your Personal Information are required to protect the information in a manner that is consistent with this Privacy Policy and any other policy and/or procedure, in effect from time to time.

We may also disclose your personal information:

• To comply with any court order, law, or legal process, including to respond to any government or regulatory request, in accordance with applicable law;

Consent may be express (e.g. orally, electronically or on a form you may sign describing the intended uses and sharing of Personal Information) or implied (e.g. when you provide information necessary for a service you have requested, such as providing us with your name, phone number and/or email), or in some circumstances where notice has been provided to you about our intentions with respect to your Personal Information and you have not withdrawn your consent for an identified purpose, such as by using an "opt-out" option, subject to applicable laws. Consent may be given by your authorized representative (such as a legal guardian, person having a power of attorney or a mandatary). Right to Withdraw Consent and Unsubscribe

Security, Retention and Destruction of Personal Information

We endeavour to protect your Personal Information using physical, electronic or procedural security measures as are appropriate and proportional to the sensitivity of the information in our custody or control, including safeguards to protect Personal Information against loss or theft, as well as unauthorized access, sharing, copying, use or modification.

We may keep and use information about you for as long as it is needed for the purposes set out in this Privacy Policy or to otherwise meet our legal obligations, even if you are no longer a customer. Personal Information that is no longer required to fulfill the identified purposes will be destroyed or made anonymous in compliance with our internal retention policies and procedures.

Transfer of Personal Information outside your Province and/or Country of Residence

Your Personal Information may in some cases be transferred to jurisdictions outside your province (including outside of the Province of Quebec) and/or your country of residence. As a result, you understand that your Personal Information will be subject to the laws of jurisdictions other than your province and/or country of residence and may be available without notice to you to foreign government authorities under lawful orders and laws applicable in such jurisdictions. Regardless of the company or person who processes your information and where it is processed, we will take steps to protect your Personal Information in accordance with applicable data protection laws and this Privacy Policy.

Children's Privacy

We do not intend to or knowingly collect information from children or other persons who are under 14 years old or fall within the definition of a minor under applicable law. If you are a minor, you may not submit any Personal Information to us. If we discover that a child or minor has provided us with personal information, we will delete such information from our systems.

The Applications and Website contain links to a number of third-party websites that are not owned or controlled by CDM and this Privacy Policy does not apply to such websites or the use of any data by such websites. Should you decide to navigate to any websites or webpage external to the Applications or Website, you do so entirely at your own risk. External links to third party websites or webpages accessed through our Applications or Website, as well as the content on such third party websites or webpages, are not investigated, assured, guaranteed, verified, monitored, recommended or endorsed by CDM. CDM provides these links merely as a convenience to you and to other visitors to our Website, and the inclusion of such links does not imply that we endorse or recommend such websites or webpages. We specifically disclaim any liability, obligation or responsibility whatsoever for the content or use of such third-party websites or webpages. We encourage you to familiarize yourself with the privacy statements provided by all third parties prior to providing them with information or taking advantage of an offer or promotion.

Policy Changes

This Privacy Policy may be revised from time to time as CDM deems necessary or advisable in its sole discretion. We will post any privacy policy changes on our Applications and Website and, if the changes are significant, we will provide a more prominent notice. You will continue to have the ability to opt out of new non-essential uses or disclosures.
